Know the Limitations of Nuncupative Wills
Hi, I’m Oklahoma estate attorney Meg Prestige, and today I want to talk to you about nuncupative wills. What is a nuncupative will? That is an oral will, and the question we get asked is, are they legal in Oklahoma? And the answer is yes, but only under very limited circumstances, and those are the estate must be less than $1,000, the testator, the person making the will, must have been in the military service and in immediate danger of death, and two witnesses must be present, and one of them must have been asked to bear witness by the testator.
